Yesterday I posted an article on my CDV Defense Blog concerning what would happen if an alleged victim to a domestic assault contacted the police or Court and said that they were changing their story.
Not only does this type of inquiry come up in the context of domestic violence cases, it also may come up in other cases that involve a past relationship between the defendant and alleged victim.
In almost all cases if there is a false effort to change the original story it can subject both the witness and defendant to additional serious criminal charges. Because though sometimes false allegations in an otherwise caring relationship due to heated emotions, mental health issues or drug or alcohol use there are strategies that can be employed to help maximum the effectiveness of a witness truthfully recanting
false allegations. It is important that when these issues come up the defendant consult with their criminal defense attorney and that the recanting witness also consider consulting with an attorney of their own.
