What is a Conviction?
When you receive a ticket from any law enforcement officer this means that you have only been charged with the offense. You do not face the loss of points or impact on your driving record until you have been convicted in Court.
You become convicted when you either plead guilty in Court, fail to appear and are found guilty in your absence or are found guilty after a contested trial. Simply because you have received a ticket does not mean that you will automatically be convicted.
How do you Avoid a Conviction?
In order to avoid a conviction it is either necessary to obtain the consent of the police officer or a favorable Court ruling. There are many ways that a South Carolina Ticket can be challenged. This may include direct negotiation with the police officer or by contesting it in Court. Tickets from accidents not observed by the police officer are especially subject to challenge later in Court.
