South Carolina has what is called an
implied consent law. This law requires that drivers in South Carolina agree to consent to
give a breath sample at the request of law enforcement as part of a DUI
arrest. If the driver refuses this consent it will result in the defendant

is set to begin immediately and is not conditional upon the driver either
being found guilty or not guilty later in Court for the DUI. Drivers who
