South Carolina law recognizes many different types of theft. While the general larceny statute applies to situations where someone unlawfully takes another’s property, there are also laws designed to address more specific situations. For example, taking merchandise from a store without paying is prosecuted as shoplifting, and taking money or property that was entrusted to you can be prosecuted as breach of trust. Another specific situation that South Carolina law addresses separately is stealing a dog.
Under South Carolina Code § 16-13-60, it is unlawful “for any person to steal a dog in which any other person has a right of property.” The law classifies this offense as a misdemeanor. A conviction can result in a fine of up to $500 or up to six months in jail, or both, at the discretion of the court. Although this is a misdemeanor offense, it is prosecuted in the Court of General Sessions, which typically handles more serious criminal matters in South Carolina.
In addition to the $500 statutory fine, defendants convicted of stealing a dog face mandatory court costs and assessments, which can increase the total amount owed to well over $1,000. This makes the offense significantly more serious than a typical misdemeanor larceny or other magistrate-level theft charge.
It’s also important to note that if a dog has a significant economic value—for example, if it is a rare or valuable breed—a defendant could instead be prosecuted under South Carolina’s grand larceny statute, which is a felony. In those cases, the potential penalties are far more severe and can include years of imprisonment.
